Legal Notice · COM3
01Purpose
The provider, which is responsible for the website, makes this document available to users in order to comply with the obligations established in Law 34/2002 on Information Society Services and Electronic Commerce (LSSI-CE), and to inform all website users of the website's terms of use.
Anyone who accesses this website assumes the role of a user and undertakes to strictly observe and comply with the provisions set out herein, as well as any other applicable legal provision.
The provider reserves the right to modify any information that may appear on the website without any obligation to give prior notice or inform users of such obligations; publication on the provider's website shall be considered sufficient.
02Liability
The provider disclaims any liability arising from information published on its website where that information has been altered or introduced by an unrelated third party.
The provider's website may use cookies (small information files that the server sends to the computer of the person accessing the page) to perform certain functions considered essential for the website's correct operation and display. Cookies used on the website are, in all cases, temporary, with the sole purpose of making subsequent transmission more efficient, and disappear when the user's session ends. Under no circumstances will cookies be used to collect personal information.
The client's website may redirect users to content on third-party websites. Since the provider cannot always control the content that third parties introduce on their websites, it assumes no liability for such content. In all cases, the provider states that it will immediately remove any content that may violate national or international legislation, morality or public order, immediately removing the redirect to that website and informing the competent authorities of the content in question.
The provider is not responsible for information and content stored in, by way of example and without limitation, forums, chats, blog generators, comments, social networks or any other medium that allows third parties to publish content independently on the provider's website. Nevertheless, in compliance with Articles 11 and 16 of the LSSI-CE, the provider makes itself available to all users, authorities and law enforcement agencies, actively cooperating in the removal or, where appropriate, blocking of any content that may affect or violate national or international legislation, third-party rights, morality or public order. If a user considers that any content on the website may fall within this category, they are requested to notify the website administrator immediately.
This website has been reviewed and tested to ensure that it operates correctly. In principle, correct operation can be guaranteed 365 days a year, 24 hours a day. Nevertheless, the provider does not rule out the possibility of certain programming errors, force majeure events, natural disasters, strikes or similar circumstances that make access to the website impossible.
03Intellectual and industrial property
The website, including, by way of example and without limitation, its programming, editing, compilation and other elements necessary for its operation, designs, logos, text and/or graphics, is the property of the provider or, where applicable, is used under a licence or express authorisation from the authors. All website content is duly protected by intellectual and industrial property legislation and registered in the corresponding public registers.
Regardless of the purpose for which they are intended, any full or partial reproduction, use, exploitation, distribution or commercialisation requires the provider's prior written authorisation in all cases. Any use not previously authorised by the provider will be considered a serious infringement of the author's intellectual or industrial property rights.
Designs, logos, text and/or graphics that do not belong to the provider and that may appear on the website belong to their respective owners, who are themselves responsible for any dispute that may arise concerning them. In all cases, the provider has their express prior authorisation.
The provider DOES NOT expressly AUTHORISE third parties to redirect directly to specific content on the website; they must in all cases redirect to the provider's main website.
The provider recognises the corresponding industrial and intellectual property rights of their respective owners. Their mere mention or appearance on the website does not imply that the provider holds any rights or bears any liability in relation to them, nor does it imply endorsement, sponsorship or recommendation by the provider.
To submit any observations regarding possible infringements of intellectual or industrial property rights, or concerning any website content, you may do so through the following email address.
04Accuracy of information
All information provided by the User must be accurate. For this purpose, the User guarantees the authenticity of the data submitted through the forms for subscribing to the Services. It is the User's responsibility to keep all information provided to COM3 continually updated so that it reflects their actual circumstances at all times. In all cases, the User shall be solely responsible for any false or inaccurate statements they make and for any damage they cause to the provider or to third parties.
05Minors
To use the services, minors must always obtain prior consent from their parents, guardians or legal representatives, who are ultimately responsible for all actions carried out by minors in their care. Responsibility for determining the specific content to which minors have access lies with those adults. Therefore, if minors access inappropriate content on the Internet, mechanisms must be installed on their computers, in particular software, filters and blocks, to limit the available content. Although these are not infallible, they are especially useful for controlling and restricting the material minors can access.
06Obligation to use the Website correctly
The User undertakes to use the Website in accordance with the law and this Legal Notice, as well as morality and accepted standards of conduct. To this end, the User shall refrain from using the website for unlawful or prohibited purposes, in ways that harm the rights and interests of third parties, or in any way that may damage, disable, overload, impair or prevent the normal use of computer equipment or documents, files and all types of content stored on any of the provider's computer equipment.
In particular, by way of illustration and without limitation, the User undertakes not to transmit, disseminate or make available to third parties any information, data, content, messages, graphics, drawings, sound or image files, photographs, recordings, software or, in general, any type of material that:
(a) is contrary to, disparages or infringes fundamental rights and public freedoms recognised by the constitution, international treaties and other legislation in force;
(b) induces, incites or promotes criminal, degrading, defamatory or violent actions, or actions that are generally contrary to the law, morality or public order;
(c) induces, incites or promotes discriminatory actions, attitudes or thoughts on the grounds of sex, race, religion, beliefs, age or status;
(d) is contrary to people's right to honour, personal or family privacy, or their own image;
(e) in any way damages the credibility of the provider or third parties; and
(f) constitutes unlawful, misleading or unfair advertising.
